1. Who we are and how to contact us

Mwaki Motors is based in Mombasa, Kenya. We source vehicles, guide clients through local purchases and imports, and facilitate vehicle sales on behalf of owners. Mwaki Motors is responsible for deciding how personal information collected for these purposes is used.

For privacy enquiries or requests about your information, email mwakimotors@gmail.com or call 0728838186. Please use “Privacy request” as your email subject and describe what you need; do not send passwords, PINs or one-time security codes.

2. Information we collect

  • Enquiries: your name, phone number and/or email, message, vehicle of interest and preferred viewing date, if supplied.
  • Client instructions and correspondence: the preferences, budget, vehicle details and documents you choose to provide while discussing an assignment. Additional transaction or identification documents may be requested separately when needed for an agreed service; please do not include them in the public enquiry form.
  • Payment and assignment records: if you become a paying client, relevant records may include the agreed fee, invoice or receipt details and payment references you provide. The website enquiry form is not a payment page.
  • Staff accounts: email address, display name, account identifier, access role and authentication information. Where a staff member chooses Google or Lovable sign-in, the authentication provider supplies the information needed to establish that account.
  • Technical and security information: our hosting and authentication providers may process network addresses, browser/device details, requested pages, timestamps and error or security logs. Enquiry records contain a hash derived from your IP address for spam control. This is a security identifier, not a guarantee of anonymity.

3. Why we use information

We use your information to reply to requests, discuss suitable vehicles and budgets, arrange viewings, carry out agreed sourcing or sales assistance, communicate about fees and progress, keep relevant business records, and protect the website against misuse. An enquiry does not automatically subscribe you to a marketing list.

We do not sell personal information. We do not need card details, mobile-money PINs, account passwords or verification codes to answer an enquiry.

4. Our grounds for processing

Depending on the activity, we rely on steps you request before a contract, performance of an agreed service, applicable legal obligations, or legitimate interests such as securing the website and managing enquiries. Where consent is the appropriate basis, we will ask for it for that specific purpose. You may withdraw consent for future processing without affecting processing already lawfully carried out.

5. Who may receive information

Authorised team members can access information needed for their work. Hosting, database, authentication and communications providers process information to operate the service; the current website uses Vercel and Lovable Cloud. We may disclose relevant details to professional advisers or authorities where lawfully necessary.

When you instruct a sourcing, import or sale assignment, relevant information may need to be shared with the actual seller or buyer and service providers involved in the agreed work, such as inspection, shipping, clearing or registration providers. We will explain the sharing needed for your assignment and limit it to the relevant purpose.

WhatsApp, Google sign-in and any Google Maps content operate under the relevant providers’ own privacy terms. Opening an external link takes you to that provider. Google Fonts is also loaded by the website, so your browser makes requests to Google to display the typeface.

The staff workspace can use an optional AI tool to draft listing descriptions from vehicle facts supplied by staff. Customer enquiries are not automatically sent to that feature. Staff should avoid including unnecessary personal information in vehicle drafting requests.

6. Processing outside Kenya

Online hosting, authentication and communications services may process information outside Kenya. Any transfer of personal information must meet applicable Kenyan data protection requirements, including appropriate safeguards or another lawful transfer basis. Contact us if you need information about the providers or safeguards relevant to your request.

7. How long information is kept

We keep information for as long as reasonably needed to handle your enquiry or assignment, maintain records required by law, address disputes, and meet legitimate security needs. An unsuccessful enquiry does not justify keeping its information indefinitely. Relevant transaction records may need to be kept longer than routine enquiry correspondence.

Retention depends on the record and purpose; this website does not apply a published fixed automatic-deletion period. You can ask us to review whether your enquiry information is still needed. Deletion may be limited by applicable legal requirements, ongoing disputes and backup retention.

8. Security and your choices

The website restricts staff access by account roles and uses access controls for enquiry records. These measures reduce risk but cannot guarantee that every transmission or system is completely secure. Share only what is needed and notify us if you suspect misuse of your information.

Providing enquiry details is voluntary, but we need a phone number or email to reply. You may contact us directly instead of using the form. This website is not intended to collect children’s personal information; please contact us if such information has been submitted.

9. Your rights and complaints

Subject to applicable law, you can ask to be informed about our use of your information, access it, correct inaccurate information, object to processing, and request deletion where the law allows. We may need proportionate identity checks before disclosing or changing records. If a request cannot be fulfilled in full, we will explain the applicable reason.

Contact us using the details above. You may also raise a concern with Kenya’s Office of the Data Protection Commissioner (ODPC), without first having to give up any other available remedy.

10. Changes to this policy

We will update this page when our processing practices change and revise the date above. Where a change requires notice or fresh consent under applicable law, we will take that additional step. Please also read our Cookie Policy for information about browser storage and third-party content.
