1. Our business and role
Mwaki Motors operates from Mombasa, Kenya. Our main service is sourcing new and used vehicles for clients and guiding them through local purchases or imports. We also facilitate sales on behalf of vehicle owners.
We generally act as a sourcing or sales intermediary, rather than the owner of the vehicles we help clients buy or sell. The actual buyer, seller and our role must be identified in the agreement for each transaction. Our service agreement with you is distinct from the vehicle sale agreement. This distinction does not remove our responsibility for the services we provide.
Contact us at mwakimotors@gmail.com or 0728838186 for questions about these terms or a proposed assignment.
2. Website use and enquiries
You may browse vehicle listings without an account. Use the website lawfully and provide accurate information when contacting us. Do not misuse forms, attempt unauthorised access, impersonate another person or submit material that infringes another person’s rights.
Sending an enquiry, requesting a quote or asking for a viewing does not by itself authorise paid work, reserve a vehicle or create a vehicle purchase agreement. A viewing is confirmed only when our team agrees the arrangement with you. Anyone instructing a transaction must have the legal capacity and authority to do so.
3. Agreeing an assignment
Before paid work starts, we and the client should confirm in writing the requested service, scope, vehicle requirements, agreed service price, payment arrangements and any authority to incur third-party costs. Written confirmation may be an accepted quotation, signed agreement or clear correspondence identifying what is being agreed.
An enquiry is not authority to bid for, purchase, ship or sell a vehicle. Those steps require the client’s agreed instructions. A change in scope or additional charge should be explained and agreed before the additional work or commitment is made.
4. Individually agreed service fees
Mwaki Motors charges clients for its services at a price agreed with each client. There is no single website fee that applies to every assignment. The quotation or agreement should identify the fee, what work it covers, the currency, and when payment is due.
Our service fee is separate from the vehicle purchase price and from third-party expenses unless the written quotation expressly includes them. Depending on the assignment, other costs may include inspection, shipping, insurance, clearing, taxes, duties, registration, transfer, storage or delivery. The agreed breakdown should say which costs are included, which are estimates and which the client must pay separately.
Do not assume a displayed vehicle price includes our service fee or all import and transfer costs. Obtain the full written breakdown for your chosen vehicle and service before making a commitment.
5. Company paybill and bank-account payments
Clients pay through Mwaki Motors’ confirmed company paybill or bank account. Payment instructions and the amount and timing due must be confirmed directly with the company for the assignment. No paybill or bank-account number is provided in these terms; request current payment instructions from our team.
Check the recipient and payment reference before sending money, and obtain a payment acknowledgement or receipt. If you receive unexpected or changed instructions, contact the company through its published contact details to verify them. We do not need your mobile-money PIN, online-banking password or one-time security code.
This website does not provide an online checkout and does not collect card or mobile-money credentials. Payments to a vehicle seller or other third party, where relevant, must be addressed separately in the transaction instructions.
6. Listings, checks and third-party sellers
Listings invite enquiries and are not binding offers to sell. Availability, asking prices, mileage, specifications and condition should be confirmed for the particular vehicle before an agreement is made. We will aim to correct listing errors brought to our attention; this does not excuse misleading descriptions or remove rights provided by law.
Agree the checks needed for the transaction, including inspection, ownership, documentation and any applicable import or registration requirements. Do not assume a model or trim name confirms particular equipment, accident history, warranty or condition. Any seller warranty or other assurance should be recorded in the relevant sale agreement.
As a sourcing intermediary, we cannot promise that a particular third-party vehicle will remain available or that a seller will accept an offer. We remain responsible for carrying out our agreed work with the care and skill required by applicable law.
7. Imports, timing and owner-assisted sales
For imports, the assignment should identify responsibilities for sourcing, approvals, inspection, shipping, clearing, taxes and delivery. Estimates may depend on third-party availability, exchange rates, shipping schedules and official processes. Confirm the requirements applicable to the particular vehicle before purchase; a general website statement is not confirmation of import eligibility.
For an owner-assisted sale, the owner must have authority to sell and provide accurate vehicle and ownership information. Marketing authority, asking price, fees, any commission, handling of buyer funds and authority to accept an offer should be agreed in writing. A listing alone does not transfer ownership or authorise us to conclude a sale.
8. Stopping or changing an assignment
Mwaki Motors does not publish a blanket cancellation or refund schedule for every sourcing assignment. If you want to pause, change or stop work, contact us promptly so we can confirm the current stage, work already performed, funds held and any third-party commitments before further steps are taken.
Any treatment of service fees, deposits or refunds must follow the particular agreement and applicable law. A supplier’s, seller’s or shipping provider’s cancellation terms may also affect that separate contract; relevant terms should be disclosed before you authorise the commitment. Acting as an intermediary does not by itself make every payment non-refundable or remove any statutory cancellation or refund rights.
9. Responsibilities and consumer rights
We are responsible for our own services as required by the agreement and Kenyan law. You are responsible for accurate instructions, necessary approvals and payments agreed for the assignment. We will discuss material issues affecting the agreed work rather than treating estimates or third-party information as guarantees.
Nothing in these terms excludes liability that cannot lawfully be excluded, excuses fraud or misrepresentation, or removes mandatory consumer protections. A written agreement cannot take away rights that Kenyan law makes non-excludable. External websites and independent providers have their own terms; their involvement does not automatically excuse our own obligations.
10. Concerns and governing law
Raise a concern with mwakimotors@gmail.com or 0728838186, including the assignment reference, relevant correspondence and the outcome you seek. We will seek to resolve the issue through direct discussion. You remain free to use any regulator, court or other dispute-resolution avenue available under applicable law.
These terms and our services are governed by the laws of Kenya, subject to any mandatory protections that apply to your transaction. No provision here requires you to give up a remedy provided by law.
11. Privacy, content and updates
Our Privacy and Cookie Policies explain how this website handles information and browser storage. Website content and the Mwaki Motors identity must not be copied in a way that infringes applicable rights. Manufacturer names and logos identify vehicle makes and do not imply an endorsement or authorised-dealer relationship.
We may update these website terms and show the revised date above. A website update does not retrospectively change an existing service agreement or introduce a new charge without an appropriate agreement or lawful basis.
